I believe the reason is that Tableau Desktop will use the Tableau Desktop license to publish content even if the user can't interact on Tableau Server. Meanwhile the REST API is a Server component which means the REST API is checking for a Server license when executing commands, which is why this is failing. If you have specific licensing questions, I would ask your account rep.

regardless of the backend logic,
business users want a feature to justify its name.
Unlicensed (can publish) should mean Unlicensed (can publish)
