Attached is a superstore workbook that demonstrates your problem. (Version 9.0)
Sheet 3 is a basic pie chart that also uses [Parameter 4] to hide/expose the sheet for swapping.
You are right. The filter should hide the sheet if [param 4] <> 1.
But in Sheet 4 it works.
And here's why. Your basic pie chart often has nothing on the Rows and Columns shelf. The parameter interaction on Sheet 3 hides the data, but not the sheet. On sheet 4 I put a dummy dimension on columns (and did "Hide header" so we don't see a header for it.) Now when the data is suppressed because of the filter, the column is also suppressed, and the entire sheet disappears.
